I GENERAL INFORMATION
1. The website www.casapapucilor.com and its associated mobile application (collectively referred to as the "Store") are operated by Pollux International Srl, with its registered office in Bucharest at Drumul Gura Ariesului 77-85, Bl C2 Et 1 Ap 4, Sector 3, Bucharest, registered with the Bucharest Trade Register under no. J40/10596/2023. This entity also manages the personal data of the Store’s customers. For simplicity, we will refer to Pollux International Srl as "CasaPapucilor", "we", "us", or other first-person plural pronouns throughout these Terms and Conditions.
2. The Rules and Regulations ("Rules") outline the guidelines for purchasing products offered in the Store ("Products"), registering an account, and accessing other services described within the Rules.
3. You can view the Rules in the Store's footer or download the latest version in PDF format to save on your preferred device.
4. The information regarding the Products available in the Store serves as an invitation to enter into a sales contract in accordance with relevant legal provisions.
5. Each Product in the Store is thoroughly described, including details about its features, price, and the materials used in its production.
6. All trademarks, brand names, photographs, illustrations, Store layout, product descriptions, and other elements of the Store are protected by copyright or trademark laws as applicable and cannot be copied or used for personal purposes without CasaPapucilor’s permission.
7. Purchases in the Store can only be made by consumers, meaning individuals purchasing for personal use, not for business purposes. We do not sell to entrepreneurs.
II. RULES FOR USING THE STORE AND ENTERING INTO A SALES CONTRACT
1. Before placing an order or creating an account in the Store, please read and accept the Rules and Regulations. Acceptance of these Rules is required to purchase products or use other services offered by the Store.
2. The information you provide when placing an order must be accurate, current, and truthful. We may refuse to process an order if the provided information is so incorrect that it hinders order fulfillment, particularly if it affects the accurate delivery of the parcel. Before declining the order, we will attempt to contact you to correct the information and enable order completion.
3. We strive to ensure that the Store is efficient and safe to use. Our operations adhere to applicable safety standards.
4. You are prohibited from taking any actions that could compromise the security of the Store, your data, other customers' data, or the integrity of your purchases.
5. By using the Store, you agree to the following rules:
a) You must not interfere with the Store’s computer systems, including, but not limited to, introducing malicious software (malware) or attempting unauthorized access to the Store.
b) You must use the Store only for its intended purpose as outlined in the Rules—any other use of the Store’s functionality is prohibited.
c) You must not use the Store in a manner that could disrupt its operation or cause inconvenience to other users or Store employees. This includes sending advertisements or similar information to addresses listed on the Store's website and using automated tools, scripts, bots, or other technologies to automate the product ordering process.
d) You must not use the content, descriptions, images, or other graphical elements from the Store for your own or others' purposes. These elements are copyrighted by the Company and may not be used without its consent.
e) You must not hinder other customers from making purchases, including placing excessively large or unusual orders that suggest you do not intend to keep the ordered goods (this does not affect your legal right to withdraw from the sales contract as described in Section VII of the Regulations) or claiming to make purchases as a consumer while intending to resell the goods as part of a business.
6. For certain brands, we have set limits on the number of items in a particular colour or model that you can purchase in a single order. You will be notified of this limit when you reach the maximum quantity allowed for that colour pattern in your cart.
III. FORMATION OF A SALES CONTRACT
1. In the Store, you can purchase Products and access services provided by CasaPapucilor in accordance with the terms outlined in the Regulations.
2. Orders can be placed in the Store 24/7; however, orders submitted on non-business days (Saturdays, Sundays, and holidays) will be processed on the following business day.
3. We will ask you to provide the necessary information to process your order. All required fields will be marked on the purchase form. If you do not provide the mandatory information, we will be unable to process your order or issue invoices.
4. To place your order, follow these steps:
a) After selecting the Products, add them to your "Shopping Cart" by choosing the appropriate size, quantity, and color. Then proceed to the "Shopping Cart" and follow the instructions provided on the Store website.
b) You can modify the contents of your "Shopping Cart" by removing or adding Products, and you can also update your provided information until you click the "Finalise order" button.
c) Clicking the "Pay Now" button signifies that you have made an offer to purchase the selected Goods under the terms described in the Regulations. If you choose Google Pay/Apple Pay as your payment method, payment will be required to submit the offer.
5. After you submit your order, you will receive an email with the basic details of your order, including the number of items ordered, the price and delivery costs, the chosen delivery and payment methods, the estimated order fulfillment time, your contact details, and the store's information. This email will also include instructions on how to file a complaint and information on how to withdraw from the sales contract. Please note that this email is simply an acknowledgment that the Store has received your order.
6. Once we receive your order, we will notify you that it is being sent for verification at the warehouse. After the verification process, we will send you another email either confirming the fulfillment of your order ("Confirmation of order placement and dispatch") or refusing to accept your order, along with the reasons for the refusal.
7. The email referenced in point 7 ("Confirmation of order placement and dispatch") signifies that the sales contract for the products you selected has been finalized under the conditions outlined in these Regulations.
8. You can cancel your order at any time before receiving the email mentioned in point 6 ("Confirmation of order placement and dispatch") by contacting Customer Service. If you choose to cancel your order, we will send you an email confirming the cancellation.
9. If you selected online payment, your order will be cancelled if:
a) Your contact information is so inaccurate that it prevents delivery or makes it impossible to reach you for confirmation, or
b) Payment for your order is not received within 4 hours of completing the checkout process.
10. For each order, we issue an electronic invoice including VAT for the purchased Products. This invoice will be sent to the email address you provided when placing the order. By accepting the Regulations, you consent to receiving the VAT invoice electronically at the provided email address.
IV. DELIVERY AND COLLECTION OF PRODUCTS
1. We will deliver the goods purchased from the Store to the address within Romania that you provided in your order.
2. Orders are generally processed within 3 working days, depending on the delivery method you selected. During periods of high demand, such as holidays, delivery may be delayed; however, we strive to ensure that your purchases arrive no later than 15 working days after you receive the Dispatch Confirmation. The maximum delivery time should not exceed 30 days. If you choose to pay online, we may delay processing your order until payment is received.
3. The Products will be delivered to you in one of the following ways:
a) By a courier company to the address you specified within Romania, or
b) To a collection point of your choice (e.g., a courier company's collection point) depending on the options provided by Casa Papucilor.
V. PRICES AND PAYMENT METHODS
1. The prices of Products in the Store are listed in lei, inclusive of VAT, but exclude delivery costs, which are detailed separately.
2. The currently accepted payment methods are presented during the checkout process when selecting your payment method.
3. Please be aware that we may adjust the prices of Products in the Store, modify the product assortment, or introduce promotions or discounts. However, such changes will not affect already finalized sales contracts or the rights of Customers participating in a specific promotion.
4. In the event of an incorrect price being displayed, we will take all necessary steps to correct the error as quickly as possible. If the displayed price is significantly below the typical value of the product, it will be deemed invalid and erroneous according to Article 1665 of the Civil Code, and any orders placed at that price will be cancelled.
VI. COMPLAINTS ABOUT NON-CONFORMING PRODUCTS
1. The Store exclusively sells new and original Products. Casa Papucilor is responsible for any non-conformity of the Products with the contract that exists at the time of delivery and is discovered within two years of that time, in accordance with applicable regulations. Some Products may also come with a manufacturer's commercial warranty, which will be indicated on the Product page. This manufacturer's warranty does not affect the statutory conformity warranty provided by law.
2. If you believe that the products you purchased do not conform to the contract, you can file a complaint in accordance with the relevant legal provisions outlined in the Regulations.
3. You can submit a complaint in one of the following ways:
a) Return the Products in question along with a written description of the defect. You may use the complaint form available for download from our Store website, though it is not required.
b) Send the complaint by registered mail or another form of shipment to the following address:

c) You will receive information from us on how your complaint will be resolved within 15 days of receiving the Products you are complaining about.
4. In accordance with the relevant legal provisions, if you submit a complaint regarding Products purchased from the Store, you have the right to:
a) Request that the Products be brought into conformity with the contract through either replacement or repair. If the chosen method of bringing the Products into conformity (replacement/repair) is impossible or would impose excessive costs on us, we may choose to replace the Products instead of repairing them, or repair them instead of replacing them.
If both repair and replacement are impossible or would require disproportionate costs for us, we may refuse to bring the products into conformity in the manner you requested. In such cases, you have the right to terminate the contract or request a price reduction.
b) You can request a price reduction (specifying the amount) or terminate the contract if:
- We have not repaired or replaced the Products as required by the Regulations, or if we have refused to do so because it was either impossible or would incur disproportionate costs;
- The Products remain non-compliant with the contract even after we have attempted to rectify the issue through repair or replacement;
- The non-compliance of the Products with the contract is significant enough to justify an immediate price reduction or termination of the contract without requiring prior repair or replacement;
- We have stated that we will not bring the Products into conformity (through repair or replacement) within a reasonable time or without causing you significant inconvenience, or it is evident from the circumstances.
You are not entitled to terminate the contract if the non-conformity is minor.
5. If your complaint is rejected, we will return the goods to you along with a notice explaining the reasons for the rejection.
6. When receiving your package, please check for any damage. If the products are damaged, request that the carrier or the person delivering the products at the collection point prepare a damage report.
7. Out-of-court dispute resolution:
a) If you purchase products as a consumer, you have the right to use an out-of-court method of dispute resolution through the interactive Online Dispute Resolution (ODR) platform in accordance with Regulation (EU) No 524/2013 of the European Parliament and Council of May 21, 2013, which establishes an online system for consumer dispute resolution and amends Regulation (EC) No 2006/2004 and Directive 2009/EC, referred to as the "ODR Regulation."
b) The ODR platform is an interactive tool available to consumers within the European Union, allowing them to file complaints online. You can access the ODR platform at: ec.europa.eu/consumers/odr. According to Article 1 of the ODR Regulation, the platform's purpose is to offer consumers a tool for the independent, impartial, transparent, effective, efficient, fast, and fair online resolution of out-of-court disputes between consumers and traders in the European Union.

VII. PRODUCT RETURNS - WITHDRAWAL FROM THE SALES CONTRACT
1. If you purchase Products as a consumer, you have the right to withdraw from the sales contract without providing any reason, under the conditions outlined below. However, this right does not apply in the case of:
a. Sealed goods that are not suitable for return due to health or hygiene reasons, if their packaging has been opened after delivery;
b. Sealed audio or video recordings or sealed computer software, where the packaging has been opened after delivery;
c. Newspapers, periodicals, or magazines, except for subscription agreements for such publications.
2. You may withdraw from the sales contract for Products purchased from the Store within the statutory 14-day withdrawal period of receiving the Products.
3. You can exercise your right of withdrawal as follows:
a) Notify us of your decision to withdraw from the contract in any manner, such as by emailing us at: info@casapapucilor.com;
b) If you submit a withdrawal notice to the Store’s email address, we will promptly acknowledge receipt by responding to your email;
c) You will meet the withdrawal deadline if you send the package by mail or notify us of your decision to withdraw via email or other means before the withdrawal period expires;
d) Return the products related to the withdrawal to the following address:

4. If you choose to withdraw from the contract:
a) You will be responsible for covering the costs of returning the Goods related to the withdrawal.
b) We will refund the payments received from you promptly, and no later than 30 days from the date we receive your withdrawal statement. This refund will include delivery and payment costs if you return all products purchased in a single order. We may, however, delay the refund until we receive the returned products or until you provide proof of their return, whichever occurs first.
c) The refund will be processed using the same payment method you originally used unless you agree to an alternative method. In any case, you will not incur any additional costs for the refund.
5. Please be aware that you are legally responsible for any reduction in the value of returned Products resulting from handling them beyond what is necessary to establish their nature, characteristics, and functioning.
VIII. INFORMATION ON SERVICES PROVIDED ELECTRONICALLY
1. Through the Store, CasaPapucilor offers the following electronic services to Customers:
a) The ability to enter into online sales contracts for Products in the Shop in accordance with the Regulations.
b) The option to create a Customer account in the Store and utilize its features, as described in point IX below.
c) Browsing the Store's web pages.
2. You have the right to withdraw from contracts for the sale of products in the Store under the conditions specified by applicable legal provisions and the Regulations.
3. For the service of maintaining an account in the Store, you have the right to withdraw within 30 days from the date of account creation. Additionally, you may request the termination of your account at any time. To exercise either of these rights, you can notify us by emailing info@casapapucilor.com or by sending a letter to CasaPapucilor.com, Pollux International Srl, Drumul Gura Ariesului 77-85 Bl C2 Et 1 Ap 4, 032605 Bucuresti, ROMÂNIA.
4. To use the Shop and its features effectively, you will need:
a) Access to the internet.
b) A web browser such as Chrome, Safari, Opera, Firefox, or a similar alternative.
c) An active email account.
5. If you wish to file a complaint regarding the services provided by Casa Papucilor, you can do so by sending an email to info@casapapucilor.com. Please include details of your complaint and your preferred resolution. We will address your complaint as quickly as possible, and you will receive a response within 15 days of our receipt of your complaint.
IX. FRAUD PREVENTION
1. CasaPapucilor.com reserves the right to decline an order and restrict certain account functionalities if you significantly violate the terms for using the Shop or entering into a sales contract as outlined in clause II.
2. Before restricting any account functionalities, we will notify you via email, providing the reasons for the potential restriction and giving you an opportunity to present your perspective.
3. If your account functionalities are restricted, CasaPapucilor.com will inform you through a message displayed when you attempt to place an order or when you log into your account, including the reason for the restriction.
4. Restrictions on your account may limit your ability to:
a) Place Orders.
b) Independently edit the email address and phone number associated with your account.
During the restriction period, you will still have access to other account features, such as viewing your order history.
5. If your account functionalities have been restricted, you have the right to appeal the decision within 14 days of receiving the restriction notice. To appeal, send an email to info@casapapucilor.com. CasaPapucilor.com will review your appeal within 14 days of receiving it and will inform you of the outcome.
6. Blocking certain account functionalities does not impact the processing of orders that CasaPapucilor.com has already confirmed and dispatched, as outlined in point III.
7. The blocking of account functionalities does not interfere with your right to withdraw from the contract for orders that were processed and dispatched prior to the blocking.
XI. FINAL PROVISIONS
1. Before finalizing a purchase in the Shop, you must review and accept the Regulations. With each order, you will be provided an opportunity to read the Regulations. If you have a Store account, we will notify you by email of any changes to the Regulations. If you do not agree with the proposed changes, you may request to delete your Store account at any time.
2. The sale of products in the Store is governed by Romanian law, and the contract is conducted in the Romanian language.
3. Personal data is processed in accordance with the Privacy Policy, available at: https://casapapucilor.com/GDPR.
4. In any matters not covered by the Regulations, the relevant provisions of Romanian law will apply.
5. We may amend the Regulations in situations such as:
a) Changes in legal provisions or their interpretation by competent authorities, court rulings, or as a result of explanations, interpretations, or recommendations issued by relevant state bodies, which affect the content of the Regulations.
b) Changes in the manner of providing the services covered by the Regulations, which may be driven by technical, technological, or security reasons, or the need to enhance the operation of the Store or improve the quality of services provided.
c) Modifications to the scope or manner of services provided under the Regulations, including the introduction of new features or services, or the modification or removal of existing ones.
d) Changes to payment or shipping methods.
e) The need for editorial revisions.
6. Amendments to the Regulations will apply to sales contracts concluded in the Shop after the changes have come into effect.
